All other trademarks, service marks, and trade names used on the Websites are the property of their respective owners.
Some portions of the Websites are made possible by third parties. We (including any of our affiliates) do not control any third parties and are not responsible for any losses or harm that any third party may cause to you, whether directly or indirectly, in connection with the Websites or otherwise.
We work continuously to improve the Websites. We offer the Websites without warranties, unless we have specifically stated a warranty applicable to a specific product or service in separate terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TOKENWORKS OR ANY OF OUR RESPECTIVE OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE LOSSES OR DAMAGES, OR DAMAGES FOR SYSTEM FAILURE OR MALFUNCTION OR LOSS OF PROFITS, DATA, USE, BUSINESS OR GOOD-WILL, ARISING OUT OF OR IN CONNECTION WITH THE WEBSITES OR THESE TERMS, WHETHER ARISING IN CONTRACT, TORT, STRICT LIABILITY, STATUTE OR ANY OTHER LEGAL OR EQUITABLE THEORY.

Survival. The provisions of these Terms that by their nature would reasonably be expected to survive any termination of these Terms, including but not limited to the provisions regarding intellectual property, limitation of liability, and indemnification, shall survive any termination of these Terms.
Entire Agreement. These Terms constitute the entire agreement between you and us with respect to your use of the Websites and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether oral or written. There are no third-party beneficiaries to these Terms.
Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflicts of law principles. Any and all legal actions, suits, or proceedings arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York City, and each party hereby irrevocably submits to the personal jurisdiction of such courts.
Severability (Restated). If any provision hereof shall be held to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions of these Terms shall continue in full force and effect.
